To all and Singular the Faithful in Christ to whom these our present Letters Testimonial Shall Come on whom the matters here Written do or may hereafter in any way Concern William by Divine Permission Bishop of London Sendeth Greeting in our Lord God everlasting and will that undoubted faith be given to these pre.. [PAGE BENT] and do make Known and will that it be herein made Known to you that on Searching the ley.. [PAGE BENT] of the Consistorial and Episcopal Court of London the archives thereof there well and faithfully Preserved [PAGE BENT] and Kept we have found among other things in the Same that on the fifth day of November in the year of our Lord one thousand and thirteen at London before the Worshipful Sam...[PAGE BENT] Pearce Pearson Doctor of Laws and Surrogate the Right Honorable Sir William Scott Knight also doctor [PAGE BENT] of Laws Vicar General and official principal of the Consistorial and Episcopal Court of London fully Constitute the last Will and Testament as [PAGE BENT] Seventeen Codicils of Haughton James formerly of Grosvenor place but late of Piccadilly in the County [PAGE BENT] Middlesex Esquire deceased was proved approved and registered and administration of all and Singular the goods Chattels and Credits of the said deceased [PAGE BENT] or any way Concerning his said Will was given to Rose Fuller Esquire one of the Executors named in [PAGE BENT] his said Will he having been already Sworn well [PAGE BENT] and Faithfully to administer the same and to [PAGE BENT] a true and perfect Inventory of all and Singular [PAGE BENT] said Goods Chattels and Credits and to Exhibit the Same into the Registry of our said Consistory Court [PAGE BENT] before the last day of February next Ensuing and to render a just and true account thereof a power Reserved of Making the like Grant to William Rhodes James the other Executor named in the said Will [PAGE BENT] when he Shall apply for the Same which said Will [PAGE BENT] and Codicils follow in these Words

This is the last will and Testament of Haughton James of Piccadilly in the County of Middlesex first I direct [c.o. be] that all my Just debts be paid by my Executors hereinafter names I give devise and bequeath my freehold plantation or Estate in Jamaica Called Haughton Tower in the parish of Hanover with the buildings thereon and all the Coppers Stills and other Utensils thereto belonging and all the Negroes Stock and Cattle thereon or thereto belonging and all other Estates and property in the said Island to William Rhodes James Esquire (Grandson to my late Attorney & Cousin William Rhodes James deceased Some few years Since and to his heirs Executors and Administrators absolutely Subject however to the Payment of an annuity of two hundred and fifty Pounds of lawful Money of Great Britain to Mrs Sarah Read Commonly Called Mrs Kingston now or lately residing in New Norfolk Street Park Lane for and during her Natural life which annuity I Secured to her many years Since by my Bond and which I hereby charge on the said Estate I also give and bequeath to Rose Fuller Esquire of Clements Lane London the Sum of three hundred pounds of like Money I give and bequeath to Francis Romart my present Valet de Chambre five hundred pounds of like Money I give and bequeath to George Chapman my footman fifty pounds of like Money and give and bequeath to William Goldfinch my Coachman fifty pounds of like Money I give and bequeath to Mary Tinmouth my Cook fifty pounds of like Money I give and bequeath to John Brown my Valet above mentioned [sic] all my Cloaths and Wearing apparel of all Kinds all the residue of my Estates and Effects Whatsoever and Wheresoever I give and bequeath to the above named William Rhodes James Esquire whom I also name and appoint together with the above named Rose Fuller Esquire Executor of this Will and I hereby revoke all my former Wills declaring this to be my last [c.o. Appeared Personally Augustus Eliot Fuller of Clements Lane in the City of London Esquire and John Haster of the Same place Gentleman and being Sworn on the holy Evangelist to depose the Truth made oath as follows that they Knew and were well acquainted with Haughton James formerly of Grosvenor place but late of Piccadilly in the County of Middlesex Esquire deceased for Some time before and up to the time of his death also with his Manner and Character of hand Writing and Subscription having often Seen him Write and Subscribe his Name and having now very Carefully viewed and perused the Several paper Writings hereunto annexed purporting to be and Contain Seventeen Codicils of the last Will and Testament of the said deceased the first of the said Codicils dated August 12 1812 in the Words following I do by this Codicil to my Will Written in my own hand give and bequeath to the Marchioness of Salisbury three hundred pounds for her Sole and Separate use independant of the Controul of her husband and thus Subscribed H James" the Second Codicil of the same date in the words following I do by this Codicil to my Will written with my own hand [c.o. Appeared Personally Charles Welstead of Berners Street Oxford Street in the County of Middlesex Gentleman and Made oath that he Knew and was well acquainted with Haughton James formerly of Grosvenor place but late of Piccadilly in the County of Middlesex Esquire and is one of the Subscribed Witnesses to the last Will and Testament of the said deceased hereunto annexed beginning thus this is the last will and Testament of Haughton James of Piccadilly in the County of Middlesex ending thus in Witness whereof I have to this my Will and to a duplicate thereof Set my hand and Seal this nineteenth day of March in the year of our Lord one thousand Eight hundred and twelve and thus Subscribed Haughton James and that on the said Nineteenth day of March the said deceased attended at the office of the appearer in Berners Street aforesaid for the purpose of Executing his said Will which he the deceased brought with him having Previously Written the Same himself and producing the Same to him the appearer and Richard Arnold of Berners Street aforesaid and Charles Wilcox the appearers Servant he the said deceased did then on the said Nineteenth day of March being the day of the date of the said Will Set and Subscribe his name thereto in manner and form as the same now appears thereon and did seal publish and declare the Same as and for his last Will and Testament in their presence and that at the request of the said deceased the deponent the said Richard Arnold and Charles Wilcox did Severally Set and Subscribe their Names as Witnesses thereto in the presence of the said deceased and of Each other and the said deceased of his said Will did nominate Constitute and appoint William Rhodes James and Rose Fuller Esquires Executors and the said original Will being now produced and Shewn to the Deponent and he having Carefully Viewed and Inspected the Same Saith that the Names Chas Welstead now appearing Set and Subscribed to the said Will is of the deponents proper hand writing and Subscription and He thereby knows the said Original Will so as aforesaid produced to him to be the very Paper Writing which he the said deceased on the said Nineteenth day of March Set and Subscribed his name to and published and declared to be and Contain his last Will and Testament in the presence of this deponent and the said Richard Arnold and Charles Wilcox and Lastly this deponent Saith that at all and Singular the Premises

In the name of God amen I Montague James of the parish of Hanover in the Island of Jamaica Esquire but now residing in the parish of Saint Ann Westminster in the County of Middlesex do make publish and declare this my last will and Testament in manner and form following that is to say I Give and Bequeath unto my Dear wife Mary James all my Plate Jewels Houses Furniture Linen Carriages and Carriage Horses also the sum of one Thousand Pounds of good and lawful money of Great Britain and I further Give and devise unto my said Wife Mary James her heirs and assigns any two of my negroe Women Slaves whom she shall make Choice of And Whereas my late Father in Law Philip Haughton Esquire deceased by his last will and Testament in writing bequeathed unto my three daughters Catherine Haughton James now Catherine Haughton Jackson the wife of Edmund Jackson Merchant Mary Haughton James and Elizabeth Haughton James the sum of Two thousand pounds Sterling each to be paid them at the age of Twenty one years or day of Marriage and in the meantime to be kept at Interest which Legacies having been received by me I do therefore will and Direct that the several Legacies and the Interest acruing thereon or such part thereof as shall not be paid by me during my lifetime and satisfied out of my Estate Also I give and bequeath unto my said Daughter Mary Haughton James when and if she attains the age of Twenty one years or is married (which shall first happen) the sum of two Thousand pounds of good and lawful money of Great Britain the same to bear and Carry Interest at the rate of Five pounds p Centum per Annum from the day of my decease and the Interest to be paid and applied in the maintenance and Education of my said daughter Mary Haughton James Also I give and bequeath to my said Elizabeth Haughton James when and if she attains her age of twenty one years or is married (which shall first happen) the like sum of Two thousand pounds of good and lawful money of Great Britain the same to bear and Carry Interest at the rate of Five pounds per Centum per annum from the day of my decease and such Interest to be paid and applied in the maintenance and Education of my said Daughter Elizabeth Haughton James Also I give and bequeath unto my Daughter Sarah Haughton James when and if she attains her age of Twenty one years of is married (which shall first happen) the sum of Four Thousand pounds of good and lawful money of Great Britain the same to bear and Carry Interest at the rate of Five pounds per Centum per annum from the day of my decease and such Interest to be paid and applied in the maintenance and Education of my said daughter Sarah Haughton James Also I will and direct that two new negroe Slaves for each of my said found Daughters Catherine Haughton Jackson Mary Haughton James Elizabeth Haughton James and Sarah Haughton James be purchased as soon as Convenient after my decease and Conveyed unto my said Daughters respectively and their respective heirs and assigns Also I give and bequeath unto my son John Haughton [X above name] an annuity or yearly sum of one hundred pounds of good and lawful money of Great Britain until his age of Twenty one years Also I give devise and bequeath all and every the negroes and other Slaves Stock and plantation utensils belonging unto me that shall be upon Hogg River Green Island and Haughton Tower Plantations or any other Estate to my said Wife Mary James at the time of my Decease unto and to the use of my said Wife Mary James and her assigns for and during the time of her natural life and from and immediately after her decease then to the use of my said son John Haughton James and the heirs of his Body lawfully begotten remainder to the use of my said four daughters Catherine Haughton Jackson Mary Haughton James Elizabeth Haughton James and Sarah Haughton James equally to be divided between them share and share alike as Tenants in Common and not as Joint Tenants and to the heirs of their several and respective Bodies lawfully Issuing and in Case any or either of them my said Four Daughters shall happen to Depart this life without Issue then as to the share or shares of her or them so dying to the use of the Survivors or Survivor of them and the heirs of her or their bodies lawfully Issuing Also I give Devise and Bequeath all that my Plantation and Sugar work called Spring Plantation and the land there unto belonging situate in the said parish of Hanover in the Island of Jamaica and the negroe and other Slaves Cattle Stock plantations Utensils and implements of Planting upon and belonging thereto also my Run of Land called Montague Hall adjoining to the said plantation a parcel of Land adjoining to the said last mentioned run and which I purchased of William Rhodes James and Thomas James my pen called Burnt Ground and the Lands thereunto belonging and my Barquadier and Lands at Davis Cove also purchased by me of the said William Rhodes James and Thomas James also Situate in the said parish of Hanover also a parcel of Land situate at Negril in the parish of Westmoreland in the said Island of Jamaica and all other my lands Tenements slaves and hereditaments Real and personal whatsoever and wheresoever not herein before disposed of and Subject always to and Charged and Chargeable with the payment of my Just debts and Funeral Expences and the several Legacies by me given and bequeathed unto and to the use of my son Samuel Torrent James and his assigns for and during the Term of his natural life And from and immediately after the determination of that Estate by Forfeiture or otherwise in the lifetime of my said son Samuel Torrent James To the use of William Rhodes James of the parish of Trelawny in the the Contingent uses and Estates hereinafter limited from being defeated or destroyed and for that purpose to make Entries and bring actions as occasion shall require but never the less to permit and after the decease of my said son Samuel Torrent James To the use of the first and every other son of the body of the said Son Samuel Torrent James lawfully begotten successively and according to Priority of birth and the heirs of the body of every such Son lawfully Issuing respectively and successively Remainder to all and every the Daughters of the Body of my said son Samuel Torrent James lawfully begotten to be Equally divided amongst them Share and share alike as Tenants in Common and not as Joint Tenants and of the several and respective heirs of the Bodies of every such Daughter lawfully issuing with Cross Remainders between them, Remainder to the use of my said son John Haughton James and his assigns for and during the Term of his natural life remainder to my said Trustees and their heirs during the life of my said Son John Haughton James In Trust to preserve Contingent Remainders, Remainder to the first and every other Son of the body of my said son John Haughton James lawfully begotten Successively and according to Priority of birth and the heirs of the body of every such Son lawfully issuing respectively and Successively Remainder to all and every the Daughters of the Body of my said Son John Haughton James lawfully begotten to be Equally divided amongst them share and share alike as Tenants In Common and not as Joint Tenants and of the several and respective Whereas I have now in my possession twelve Slaves named Pompey Paimus Jenny and her Child Dutchess Bell Frederick Lucea Floramel Delai Dolly and her Child Lucestreba and Anna which were given to my beloved Wife Rachel Allan James by her late Father and as there is some doubt whether the title does not vest in myself to remove all doubts respecting her Title to those Slaves I Give devise and bequeath the said Twelve Slaves and all Property I have therein unto my said beloved Wife To hold the same with the Issue and increase of the female Slaves to her and her heirs and Assigns forever I give devise and bequeath unto my said beloved Wife Rachel Allan James my Six Slaves named Nancy and her Children Amarellis and Tommy James Pickle and Mulatto Sam To hold the same with the future Issue and Increase of the females unto my said Wife during her natural life and upon her decease the same to revert to and be part and parcel of my residuary Estate I Give absolutely to my said Wife my Horses Carriages Plate and Household furniture to be at her own disposal All the rest residue and remainder of my Estates Real Personal and mixed whatsoever and wheresoever the same may be whereof I shall die seized and Possessed or whereunto I may be intitled at the time of my decease I Give devise and bequeath unto my beloved Wife Rachel Allan James and my friends Herbert Newton Jarrett of Orange Valley in the Parish of Trelawny and William Brown of the Parish of Hanover Esquires and the Survivor of them and the heirs Executors Administrators and Assigns of Such Survivor forever Upon Trust Nevertheless and to and for and upon the several uses trusts ends intents and purposes hereinafter mentioned and declared of and concerning the same that is to say Upon Trust in the first place to manage conduct improve defend and protect the same And in the next place until all my debts and funeral Charges shall be fully paid to receive and take the Rents Issues and Profits thereof and to pay and apply the same in matter following that is to say thereby and thereout to pay the Contingent Charges and to make from time to time purchases of Slaves and Stock such as shall be needful and proper for the Cultivation support and improvement of my landed property And upon further trust thereby and thereout to pay and apply an annual sum for the maintenance and Education of my Children in manner next mentioned that it to say for the maintenance of each Son until he shall respectively attain his age of Eighteen years such reasonable sum of money as my said Trustees as judge moot proper and best suited to his Age and to the Circumstance and Condition of my Estate And from the day on which my Sons shall respectively attain the Age of Eighteen years then to allow each Son Two hundred and fifty pounds Annually for his support and maintenance until my debts be fully paid And for the maintenance and Education of each daughter to allow in like manner an annuall Sum at the discretion of my said Trustees untill the day on which such Daughter shall respectively attain the Age of Eighteen years or be married whichsoever shall first happen at which time my Daughters will be intitled to receive their portions hereinafter mentioned but in case it shall so happen that the Portion be not actually paid at that period then to pay annually unto each daughter for her maintenance the lawfull Interest of her Portion or such part thereof as shall be unpaid it being my will and intention that the Portions of my said Daughters shall not bear Interest until the times whereon the same are respectively made payable as hereinafter mentioned And upon further Trust to pay and apply the residue thereof or so much thereof as shall be necessary for that purpose toward the paying off and discharging my just debts And Upon further Trust thereby and thereout to raise for my Daughter Juliana James the Sum of Three Thousand Pounds Currency as and for her Portion to be paid to her at the Age of Eighteen years or day of Marriage whichsoever shall first happen And also the like sum of Money and payable in like manner as and for the Portion or Portions of each and every of my future Daughters in case that any shall be born unto me in my life time or in due time after my decease Provided always that if any or either of my daughters shall happen to die unmarried and before she attains the age of Eighteen years then and in such Case the portion so appointed to be raised for such Daughter or Daughters so dying shall lapse and sink into my Estate And upon further Trust that if it should it (sic) so happen that a sufficient sum cannot be raised for payment of the Portions of my daughters so that the same or any part thereof be behind and unpaid the space of twelve months next after the same are hereby made payable then and in such Case to raise money by way of loan Mortgage or other Security of the Trust premises as shall from time to time be requisite for payment of the said Portions respectively
And Upon further Trust that whensoever and so soon as all my Just debts shall have been fully paid and my Estate cleared of debt except it be a new debt Contracted for payment of my Daughters Portions as next before mentioned Then and from thence forward for ever to hold all and singular the Premises hereby devised in Trust to them unto and to the only proper use benefit and behoof of my Eldest Son William Rhodes James and his heirs and Assigns Subject Never the less to the limitations herein after mentioned and also subject to the payment of my Daughters Portions or so much thereof as shall be then unpaid and to any Mortgage or other Security granted by my Trustees for the purpose of raising Money for those Portions as before mentioned And Also the Portions and Provision for my younger sons Herbert Jarrett James and Henry John James and my future younger Sons in Case any shall be born unto me in my life time or in due time after my decease that is to say that my said Trustees shall cause my whole Estate to be then valued and appraised by two sufficient and indifferent valuators one of whom to be named by my eldest Son if more than Eighteen years of age and living or duly represented in this Island or otherwise by his nearest relation in this Island who will nominate in his behalf And in case of difference of opinion the Valuators shall name an Umpire as in such Cases is usual whose valuation shall be Conclusive and allow once being made for any Sums which may be Due on account of my Daughters Portions the Nett Value of my Estate shall be divided into shares exceeding by one the number of Sons then living or who have died after having attained the Age of Twenty one years or have left lawfull issue And my Eldest Son shall be Considered as intitled to two of such Shares and each younger Son to the value of one of each such Share to be paid by my eldest Son in manner hereinafter mentioned And in order to prevent disputes I declare expressly my will and intent to be that the portion or share of my younger Sons shall lapse and sink into my Estate in case of the death of any or either of them both under the Age of Twenty one years and without lawfull (sic) And that every of such Son or Sons shall have power by Will or deed in writing to make disposal of his Rights and Claims to such share and portion so soon as he attains such Age and in default of such writing then the same shall become the property of his Issue if more than one share and share alike and in default of his issue it shall belong to his Right Heirs except only in case that my eldest Son shall happen to die under Age and before my Estate be clear as aforesaid without lawfull Issue then living or having left lawfull Issue and such Issue then living be females only then and in such Case such female issue shall be entitled only to the value of one of the two Shares intended for my Eldest Son and the other of the said two Shares shall go to my next eldest Son who shall then stand in the place of and be in all respects entitled and Considered as my now eldest Son William Rhodes James is hereby entitled and Considered and so on throughout all my Sons And with intent that my eldest Son shall not be inconvenienced or his property distressed by paying the portions of my youngest Sons I will and direct that the share and portion of my younger sons shall be paid to them their Devisees Assigns and Right heirs as the case may be in manner following that is to say each share or proportion shall be considered as due vested on the day each Younger Son shall respectively attain his Age of Twenty one years and interest shall then Commence But Nevertheless my Eldest Son shall have time of payment and each portion shall be paid by him in five installments the first payment to be made after each Son respectively attains his age of Twenty one years or when he would have attained that Age in case of his death under that age and leaving lawful Issue to which issue the same will then be payable by the like Instalments with Interest from that time And upon further Trust in Case of the death of my Son William Rhodes James under the Age of Twenty one years and without lawfull Issue Male then to hold the same to the use of my second son Herbert Jarret James and his heirs and Assigns for Ever Subject in all respects as herein before mentioned in regard to my Son William Rhodes James in whose place and stead he will then be put And in case of the death of my said second Son under such Age and without lawfull issue Male then in like manner to the use of my next Eldest son and his heirs and Assigns Subject in like manner and so on to toties quoties throughout all my Sons And for the better and more effectual securing the due payment of the Portions of my Daughters and Younger Sons in manner as at the times herein before limited for payment I declare the same to be specific Liens on my Estate secured under the Trusts hereby created and to that intent that the same be and remain vested in my said Trustees until those portions be fully paid And I hereby authorize and empower my said Trustees and each of them in case of default of payment whensoever and so often as the same shall happen to enter upon and take possession of my Estate and Property and to take the Rents Issues and Profits thereof to the payment of as well all Monies so in arrear and unpaid on Jamaica Ss - In Obedience to the Warrant of Appraisement hereunto annexed and to us directed We have according to the best of our Judgments and Consciences Inventoried and appraised all and Singular the Goods and Chattels Rights and Credits which were William Rhodes James the Elder late of the Parish of Trelawny Esquire deceased according as the same were Shewn unto us by William Rhodes James of the Parish of Saint Catherine his Administrator or which we know did belong to the deceased at the time of his death and we find the Same to Amount to the Sum of Sixteen thousand two Hundred and Eighty Six pounds two Shillings and Six pence Current Money of Jamaica ____ All which we humbly Certify under our hands and Seals this fifteenth day of Febry 1808 _
