I bequeath to my wife and sons James, William, Frederick, George and Theophilus and to my "only daughter" Charlotte Elizabeth, the house and lands in King Street, Falmouth.  I also desire that the two boats the Rover and the Return are not to be sold.  My half share in the Lily, the Argosy, and the Mabel are not to be sold either under any consideration.  I desire that [from] my Assurance in the New York Life Insurance Company for $1,000. [sentence incomplete].  I bequeath Forty Pounds to Alexander Garth and Hannah Garth, illegitimate children, to buy them a house and a piece of land, and the remainder of the $1,000 to my wife and children.

His great grandson went Falmouth in 2006 to search for relatives, as he had heard that his great grandfather was born in Falmouth, and that his name was Garth

        4.  James2 Syms (James1) was born Bef. August 01, 1757, and died December 1820.  He married Jane Casey August 13, 1792 in St. Ann9.  She was born Bet. 1767 - 1776.

On a list of slave owners in St. Ann in 1792, James Syms had 32 slaves and 4 stock. The name of the property was not included.

James Syms fulfilled his obligatory service in the local Militia by serving in the Horse Regiment in St. Ann.  In 1795 he was a Cornet in the 1st or Western Troop of Horse (reported in 1796 Almanac).  On June 27, 1795 he was commissioned as a Lieutenant in  the St. Ann's Western Troop of Horse. He continued to serve until at least 1807 (reported in the 1808 Almanac).  He was not listed in the next Militia list that was transcribed (1817).

Baptized in St. Ann on July 24, 1815, at the same time as his grandson, John Higgin, were the following slaves of James Syms Esq.:

A comparison of slave ownership for James Syms/Symes/Sims at Arabia Felix as shown by the Jamaica Almanacs (reporting March of the prior year) and the obligatory Slave Returns (reported in June every 3 years for 1817-1832) shows the following for his property Arabia Felix:

In the name of God Amen.  I James Syms late of the Parish of Saint Ann in the County of Middlesex and Island of Jamaica but now on board ship on my passage out to the said island Esquire do make this my last Will and Testament in manner following that is to say first I give devise and bequeath unto my truly and justly beloved wife Jane a negro woman named Cleona with her issue and increase to my said wife and her heirs for ever
Item  I also give devise and bequeath unto my said Wife Jane the place lately purchased from the heirs of Seville Estate with her choice of their house servants to hold the said Land and house servants during the natural life of my said wife and afterwards to revert to and become part of my Estate
Item  I give and bequeath unto my two Sisters Jane Kerr and Mariann Dunlop both of the parish of Stewarton in the County of Ayr North Britain fifteen pounds Sterling each with lawful Interest till paid the first payment to commence within twelve months after my demise and to continue during their natural lives respectively
Item  all the rest residue and remainder of my Estate Real Personal or mixed either in Jamaica or elsewhere I give devise and bequeath unto my two daughters Margaret and Eliza Mary Syms to be equally divided between them as Tenants in Common and not as joint tenants to hold my said Estate real and personal to my said two daughters Margaret and Eliza Mary and their heirs for ever
Item  Whereas I am possessed of a large extent of Land in the said Island of Jamaica the greater part of which is in wood and in an unproductive Estate therefore I do hereby empower and authorize my Executrix and Executors hereinafter named and the survivors or survivor of them to sell and dispose of to the best advantage all or any part of my Land in the said Island of Jamaica excepting my penn or plantation called Arabia Felix and the place I purchased from the heirs of Seville Estate hereinbefore mentioned both in the aforesaid parish of Saint Ann and the monies arising from such Sale or Sales to be applied to the use of my said two daughters as hereinbefore directed
Item  but in case of the death of both my said daughters without lawful issue before they shall have attained the age of twenty one or without making any legal conveyance or other disposition of my said Estate hereinbefore bequeathed then and in that case I hereby give devise and bequeath the said Estate Real and personal or mixed to my said wife Jane for and during her natural life and after her demise to my two Sisters Jane and Marianne before mentioned and their heirs for ever and lastly I do hereby nominate constitute and appoint my said wife Jane to be Executrix and my much esteemed Friends Robert McCline of the City of Cork in Ireland Adam Anderson Senior and Thomas Winder both of the aforesaid parish of Saint Ann Esquires and my kinsman Ian Pollott of the city of Kingston in the said Island of Jamaica to be Executors of this my last Will and Testament and together with my said wife Jane Guardians of the persons and Estates of my said daughters hereby revoking all other Wills by me at any time heretofore made.

Notes for Jane Casey:
In 1823 Jane Syms, as Executrix of James Syms, deceased, filed a separate return for 8 slaves.  Four of the slaves had died, and four had been born, since the last return by James Syms in 1820.  There is a notation on this return of the Executrix stating that other slaves have been reported on separate returns:
   Transferred to Jane Syms as owner: 15
   Transferred to Isaac Higgin in right of his wife:  78 slaves*
   Total: 93 slaves

(*These slaves were left at Arabia Felix and included Cleona and her two of her daughters, Sarah and Kitty).

Jane Syms filed an 1823 Slave Return as owner listing 15 slaves "acquired" from James Syms who had registered them in St. Ann.  One of them was Jane, Creole Negro aged 5 (the age when she was registered in 1817.  She was also Cleona's daughter).

There are listings for Jane Syms/Symes at the Priory as shown by the Jamaica Almanacs (reporting March of the prior year) as follows:
   1820 The Priory 10 slaves/ 5 stock (reported in the 1821 Almanac)
   1821 The Priory 10 slaves/ 5 stock (reported in the 1822 Almanac)
   1822 The Priory 10 slaves/ 2 stock (reported in the 1823 Almanac)
   1823 The Priory 11 slaves/ 3 stock (reported in the 1824 Almanac)

On her 1826 Slave Return, Jane Syms, by her agent Isaac Higgin, reported 11 slaves, and the manumission of 4 slaves, including Jane, aged 12 (If the age was accurate, she was manumized in 1824).

On her 1829 Slave Return, Jane Syms, by her agent John Anderson, reported 10 slaves.

        11.  Margaret3 Syms (James2, James1) was born June 14, 179318.  She married Isaac Higgin Bef. March 1814, son of John Higgin.  He was born Bet. 1786 - 1787, and died February 1832.

Notes for Isaac Higgin:
On March 13, 1815 he was commissioned as an Adjutant in the Horse Regiment of the St. Ann Militia (reported in the 1817 Almanac).  He was still serving in that position in 1823 (reported in the 1824 Almanac).

The Almanac first lists him as being a property owner in 1816, at Tooting in St. Ann.
  1816, Tooting, 79 slaves/ 31 stock.
  1817,  82 slaves/ 140 stock (reported in the 1818 Almanac).  
     1817  Slave Return, 84 slaves.

On December 2, 1819, Isaac Higgin patented 300 acres of land in St. Ann.  The land was surveyed by Weightman in 1820. (see Higman, page 25).

The Jamaica Almanacs from 1821 through 1831 shown Isaac Higgin as the owner (or holder) of Cave Valley and other properties.  His slave return for 1823 for Cave Valley reported 155 slaves.  In that same year he and J. C. Pownall reported as "receivers in Chancery" for Mammee Bay Estate and Malvern Park Pen.

The 1833 Almanac (reporting 1832 returns) showns the "Estate of Issac Higgin" as owning properties, so Isaac was dead by March 1832.

There was a white man by the name of Thomas Higgin, aged 30, resident at Dover, who was buried on June 28, 1828, by Thomas Rose. (It is not known if there was a connection.)
