This indenture made the fourteenth day of September in the year of our Lord one thousand eight hundred and twenty one between Henry Cerf late of the parish of St Elizabeth in the County of Cornwall in the said island of Jamaica but now of Worton Hall in the County of Middlesex in England Esquire of the one part and Maximilian Joseph Wolff of Edinburgh plantation in the parish of Manchester in the County of Cornwall in the said Island of Jamaica now in London in England planter of the other part WHEREAS the said Henry Cerf being seized and possessed in fee simple of a certain plantation, lands, slaves and hereditaments hereafter described did by Indenture bearing date the first day of August one thousand eight hundred and seventeen and made between the said Henry Cerf of the one part and the said Maximilian Joseph Wolff of the other part for certain valuable considerations in such Indenture expressed convey unto the said Maximilian Joseph Wolff his heirs and assigns one full undivided and equal Moiety in half part the whole unto 2 equal parts being divided of and in all that plantation piece or parcel of land situate lying and being in the parish of Manchester formerly part of the parish of Vere in the said Island of Jamaica commonly called and known by the name of Edinburgh containing 350 acres or thereabout be the same more or less and abutting and bounding northerly there on by ..... Naigle but now on Henry Morgan, easterly on William Burt Wright, southerly on Robert Crawford and f ...wood and westerly on Robert Crawford and Thomas Elliott together with the like part or share of and in the appurtenances [?thereby] and in all those several male and female negro and other slaves upon and belonging to the said plantation whose names were mentioned set down and contained in the schedule to this now reciting Indenture account or thereunder written and amounting in number to eighteen and of and in the future offspring and increase of the females thereof and of every of them to hold the same unto and to the use of the said Maximilian Joseph Wolff his heirs and assigns for ever and which said recited Indentured was enrolled in the office of Enrollment of the said Island of Jamaica on 4 July 1818 Liber 671 Folio 194 and whereas since the date of the said above in part recited Indenture the said Henry Cerf and Maximilian Joseph Wolff have purchased for their joint benefit as owners and for the use of the said plantation 7 male and female slaves the title deeds relating to which last mentioned slaves all now in the Island of Jamaica aforesaid so that a full and accurate description of such last mentioned slaves and all of the slaves be executed but the said last mentioned slaves have been purchased of and purchased of the purchaser...... [? Robert William Black Alexander ........... and E.....? Banks] Esquire and of such 7 negros by them respectively to the said Henry Cerf and Maximilian Joseph Wolff by........... ..... ......in the said Island of Jamaica and such now purchased slaves together with those comprized in the above recited Indenture and the issue thereof respectively now living amount in number to 56 or thereabout and whereas the said Henry Cerf hath contracted and agreed with the said Maximilian Joseph Wolff for the absolute sale to him of his remaining moiety of and in the said plantation lands hereditaments and premises together with his moiety of and in as well the several slaves comprized in the sale and annexed to the above in part recited Indenture as of those since purchased by them the said Henry Cerf and Maximilian Joseph Wolff as aforesaid and all and every the stock and cattle of the said plantation and all other his Estate right title and interest in and to the same several premises at or for the price or sum of £4,500 of sterling English money and the said Henry Cerf hath agreed to grant and convey the same unto the said Maximilian Joseph Wolff in manner hereinafter mentioned And this Indenture witnesseth that in pursuance and performance of the said recited contract and for and in consideration of the sum of £4,500 of sterling money of the United Kingdom of Great Britain and Ireland of English value and currency where the said Henry Cerf in hand well and truly paid by the said Maximilian Joseph Wolff [?and] immediately before this sealing and delivery of these presents the receipt whereof and that the same is in full payment for the absolute purchase of the said one undivided Moiety or equal half part the whole unto his equal half part to be divided and all other the Estate share right title and interest of him the said Henry Cerf of and in the said plantation land slaves hereditaments stock cattle and premises hereinbefore mentioned and hereinafter particularly described and intended to be hereby granted released and conveyed he the said Henry Cerf doth hereby admitt and acknowledge and of and from the same and every part thereof doth acquit release exonerate and forever discharge the said Maximilian Joseph Wolff his heirs Executors and administrators and every of them for ever by these presents he the said Henry Cerf hath granted, bargained, sold, altered, renewed, released, expressed, conveyed, assigned and confirmed and by these present doth grant, bargain, sell, alter, renew, release, express, convey, assign and confirm unto the said Maximilian Joseph Wolff his heirs Executors administrators and assigns all that the said one undivided Moiety or equal half part or share the whole into 2 equal half parts or shares to be divided and all other the Estate share right title and interest whatsoever of him the said Henry Cerf of and in all that the said plantation piece or parcel of land situate lying and being in the parish of Manchester formerly part of the parish of Vere in the said Island commonly called and known by the name of Edinburgh containing 350 acres or thereabout be the same more or less and abutting northerly late on I? .... Naigle and now on Henry Morgan, easterly on William Burt Wright, southerly on Robert Crawford .... erections and buildings on the said plantation piece or parcel of land standing, being erected and built and of and in all ways, paths, passages, water, water courses, wells and wells of water, feedings, feeding places, fishing, fishing places, ponds, woods, under woods, true timber, true hedges, ditches, fences, enclosures, commons and common of pasture, [?lights], covenants, privileges, profits, commodities, emoluments, advantages, hereditaments, rights, access, lease, appurtenances whatsoever to the said plantation lands, hereditaments and premises or any part or parts thereof belonging or in any wise appertaining or therewith or to be or with the same or any part thereof now or heretofore usually had held and occupied possessed and enjoyed or accepted, expected, received, taken or known in part parcel or number thereof or of any part thereof and also the like part or share Estate right title and interest of and in all the several male and female negro and other slaves upon or belonging to the said plantation at what time soever purchased or acquired as aforesaid and of and in the future issue, offspring and increase of the females of the said slaves and of every of them and the reversion and reversions, remainder and remainders, yearly and other rents, issues, profits and produce thereof and of every part thereof and also all and singular the stock, cattle utensils, implements and materials whatsoever belonging or appertaining to the said plantation or used or employed therewith and all the Estate rights, title, interest, use, trust, possession, inheritance, property, benefit, claim and demand whatsoever both at Law held in equity of him the said Henry Cerf of into or out of the same several premises together with all deeds, muniments, instruments and other evidence of title relating to the said plantation, lands, hereditaments, slaves, stock and premises hereby conveyed or intended so to be which now are or hereafter may be in the possession or lawful power of him the said Henry Cerf or his heirs on which he or they can or may procure without action or suit at Law or in equity to have and to hold the said one undivided moiety or equal half part or shares the whole into two equal parts or share being divided or considered deducted and all other the Estate share right title and interest of the said Henry Cerf of and in the said plantation piece or parcel of land, slaves, hereditaments, stock, cattle, utensils, instruments and premises whatsoever with these and every of these rights ...........and appurtenances and of and in the future issue offspring and increase of the females of the said slaves with the said Maximilian Joseph Wolff his heirs, executors, administrators and assigns to the truly proper use and whereof the said Maximilian Joseph Wolff his heirs, executors, administrators and assigns for ever deed to and for no other use, interest, purpose whatsoever and the said Henry Cerf for himself his heirs his heirs executors administrators doth hereby covenant, promise, dictate and agree to act with the said Maximilian Joseph Wolff his heirs and assigns in manner following that is to say that for and notwithstanding any all and manner being whatsoever by him the said Henry Cerf will indenture effect acknowledge the said Henry Cerf or otherwise convey and assign a full moiety or half part of and in the said plantation, lands, hereditaments, stock and premises herein before conveyed and assigned or interest so to be unto the said Maximilian Joseph Wolff his heirs and assigns in manner aforesaid and according to the true and meaning of these presents and also that for and not withstanding any such act deed matter or thing as aforesaid it shall and may be lawful to and for the said Maximilian Joseph Wolff his heirs and assigns from time to time and at all times hereafter peaceably and quietly to enter into have hold, use, occupy, possess and enjoy the said part share Estate and interest of and in the said plantation piece or parcel of land, shares, hereditaments, stock and premises hereby granted conveyed and intended so to be with the appurtenances and of and in the future issue, offspring and increase of the females of the said slaves without any the lawful let deed trouble denial, eviction, ejection, molestation, hindrance or interruption or disturbance whatsoever of from or by the said Henry Cerf his heirs, executors administrators or assigns or of from or by any other person or persons whomsoever lawfully obtaining or to obtain any Estate rights title or interest therein or thereto by from through under or in trust for him or them and that free and clear are freely and clearly and absolutely acquitted released exonerated and forever discharged or otherwise by the said Henry Cerf his heirs executors, administrators well and sufficiently saved, defended, kept, executed and indemnified of them and against all and all manner of former and other gifts grants bargains [?coins sales] mortgages [?trust...] dowers right a title of in or to trusts executions extents judgements fines forfeitures and all and every other charges or incumbrances whatsoever made done committed or suffered by the said Henry Cerf his heirs executors administrators or assigns and further that he the said Henry Cerf his heirs executors administrators and assigns and all and every other person or persons now or at any time hereafter rightfully claiming or having title to obtain any Estate right title and title charged interest at law in equity of into out of upon in respecting the said part share Estate right title and interest of and in the said plantation lands hereditaments slaves stock and premises hereby conveyed or intended so to be or any part thereof from under or in trust for him or them shall or will from time to time and at all times hereafter upon every reasonable request and at the fee open [be ...] and charges of the said Maximilian Joseph Wolff his heirs or assigns make do acknowledge lease suffer execute and perfect or cause or procure to be made done acknowledged leased suffered executed and perfected all and such further and other lawful and reasonable acts deeds conveyances matters and things whatsoever for the further better more perfectly fully lawfully absolutely or satisfactorily granting releasing conveying confirming and securing the said moiety or half part or other Estate share right title or interest of the said Henry Cerf of and in the plantation lands hereditaments slaves stock and premises hereby granted and conveyed or mentioned or intended so to be with every part and parcel thereof and the possession reversion and inheritance thereof with the appurtenances unto the said Maximilian Joseph Wolff his heirs executors administrators or assigns or by the said Maximilian Joseph Wolff his heirs executors administrators or assigns or his or their counsel in the law shall be reasonably advised and acquired so that such further assurance or assurances do not contain in as than or imply any further or other warranty or covenant that is against the person aforesaid who shall be required to make or execute the same his her or their devisors ancestors executors and administrators or his her or their own respective acts, deeds, concessions or defaults and so that the person or persons required to make any such assurance or assurances he sent obliged to go from his her or their place or respective place of abode for the making or executing the same and the said Henry Cerf hath made ordained executed constituted and appointed and by these present doth make, ordain, constitute and appoint and in his place and clear find and default the said Maximilian Joseph Wolff and also Alexander Hiam Cohen of Kingston in the said Island of Jamaica, merchant his true and lawful attornies and attorney trustly or either of them severally to acknowledge witness the seal of him the said Henry Cerf hereto as his act and deed before the Register or Registers or other proper officer or officers in the said Island of Jamaica in order that this indenture may be registered and recorded according to the law and constitution of the said Island of Jamaica where the same may be agreed or necessary and for the said Henry Cerf and in his name or otherwise to make do and execute all indentures things as they the said attornies or either of them shall think proper and requisite to the done act or the fact Henry Cerf could or might do for effectuating the purposes aforesaid if personally present the said Henry Cerf hereby and confirming all and whatsoever his said attorney or either of them shall lawfully do or cause to be done in the premises by virtue of these powers in witness whereof the said parties to these presents have hereunto set their hands and seal the day and year first above written Henry Cerf
