WILL OF JOSEPH D'AGUILAR, Esquire

In the Name of God Amen I JOSEPH D' AGUILAR of the City and Parish of Kingston in the County of Surry in the said Island Merchant being of sound and disposing mind memory and understanding do make public & declare this my last Will and Testament in manner and form following that is to say in the first place I desire that all my just debts and the expenses of my funeral be paid as soon as may be after my decease to the payment whereof I subject and make liable my whole estate real and personal I give and bequeath unto my honored father HANANEL D'AGUILAR the sum of fifty pounds current money of Jamaica I give and bequeath unto my honored mother the like sum of fifty pounds currency
Item I give and bequeath the legatees following that is to say to each of my brothers and Sisters that may be living at the time of my decease the sum of twenty pounds currency
To each of my brothers in law ISAAC Da SILVA  JACOB DASILVA and SOLOMON Da SILVA the sum of twenty pounds currency
To the Treasurer and Wardens of the Portuguese Jews Synagogue in the City of Kingston aforesaid for the use of the said Synagogue the sum of ten pounds currency to my daughter REBECCA D'AGUILAR the sum of two hundred pounds currency the same term to commence and bear interest the day of my decease and the said principal and interest to be paid to my said daughter on attaining the age of twenty one years or day of marriage which shall first happen
To my friends ABRAHAM LOPES TAVARES and SAMUEL PEREIRA MENDES the sum of ten pounds each to purchase a ring as a token of my regard
I give and bequeath unto my Sister in law SARAH LINDO Wife of my friend JOSEPH LINDO the sum of one hundred pounds currency and in case she should depart this life before me then I give and bequeath the same to her Children share and share alike
And whereas I have executed a deed unto DANIEL MOORE and DAVID BRAVO Esquires and whereby I have conveyed unto them three thousand pounds currency which sum I have received in right of my Wife upon certain trusts therein mentioned in which said deed there is a proviso(e) that if any profits arise from the trusts by any means whatever such profits or surplus should be for my use and disposal I give devise and bequeath such surplus if any there be and all the rest residue and remainder of my estate real personal and mixed whatsoever and wheresoever unto the said DANIEL MOORE and DAVID BRAVO their heirs exors admors [executors administrators] and assigns to hold to the said DANIEL MOORE & DAVID BRAVO their heirs exors admors [executors administrators] and assigns upon the trusts and to for and upon the uses intents and purposes following that is to say to permit and suffer my said Wife to receive the rents issues and profits and proceeds of my said real and personal estates for and during the term of her natural life the same to be for her sole seperate & peculiar use and not subject or liable to the controul debts forfeitures or engagements of any future husband she may marry and from and after the decease of my said Wife then I give devise and bequeath the same unto all and every the Children by my said Wife share and share alike and as tenants in commone not as joint tenants if more than one and if but one Child then to such one Child their his or her heirs and assigns for ever and in case there should be more than one Child and all of them should depart this life under the age of twenty one years and without lawful issue if males and under that age and unmarried if females the part or share or parts or shares of him her or them so dying to go to the survivor and survivor of them share and share alike his her or their heirs and assigns for ever and if but one survivor then to such survivor his or her heirs and assigns for ever and in case there shall be no such Child or Children living at the decease of my said Wife and if there be and all such Child or Children shall afterwards depart this life under age and without lawful issue if males and under that age and unmarried if females then I give devise and bequeath one half of the said surplus if any there __ and one half of all the rest residue and remainder of my estate real and personal unto my Sister JOY RACHAEL and MARIA to hold the same and unto my said Sister their heirs and assigns for ever and as to the other moiety of the said surplus if any there be and of the rest residue and remainder of my estate I give devise and bequeath one moiety thereof to my brother MOSES D'AGUILAR and WILLIAM KERR D'AGUILAR to hold to them in equal portions their heirs and assigns for ever and as to the other moiety I give devise and bequeath the same unto all and every the Children of JOSEPH LINDO of the United States of America and SARAH his Wife named as follows HANNAH ALEXANDRE LUISA MARY ANN SOLOMON and MATILDA share and share alike as tenants in common and not as joint tenants but in case any of them should depart this life under age and without lawful issue if males and under that age and unmarried if females then I give the share of him her or them so dying unto the survivor or survivors of them his her or their heirs and assigns for ever and in case they should all depart this life under age and unmarried if females and under that age and without lawful issue if males then I give devise and bequeath the same unto my said three Sisters to hold to them their heirs and assigns for ever
And I hereby direct that the my furniture horses and Chaise to be sold if my said Wife should think proper so to do
I hereby nominate constitute and appoint my dear Wife and the said DAVID BRAVO  DANIEL MOORE and my said Brothers MOSES D'AGUILAR and WILLIAM KERR D'AGUILAR Executrix and Executors of this my Will I should have appointed my honoured father an Executor of this my Will but it was his desire to me not to do it and hereby revoking all former Wills by me at any time heretofore made declare this and this only to be and contain my last Will and Testament
In Witness whereof I have to the two first pages of this my Will set my hand and to this my hand and seal this first day of June one thousand eight hundred and seven.

CODICIL

WHEREAS I JOSEPH DAIGLAR late of the Island of Jamaica but at present of the County of Bergen and State of New Jersey have made my last Will and Testament in writing bearing date sometime in the latter end of May or beginning of June last which said Will was left in the care of DAVID MOORE Esquire at the said Island of Jamaica by which said Will I have made constituted and appointed my beloved Wife REBECCA DAGILAR Executrix and my Brother WILLIAM DAGILAR and MOSES DAGILAR and my friend DANIEL MOORE Esquire the Executors
Thereof now I do by this my writing which I do declare to be a Codicil to my said Will and direct to be taken as a part thereof will and direct that my said Brother WILLIAM DAGILAR and MOSES DAGILAR shall not be the Executors of my said Will but that in their room and sted my friend DAVID BRAVO Esquire shall be one of the Executors of my said Will jointly and together with my beloved Wife and my friend DANIEL MOORE Esquire
I do therefore hereby accordingly ordain constitute and appoint them my said
beloved Wife REBECCA DAGILAR the Executrix and DANIEL MOORE and DAVID BRAVO Esquires the Executors jointly and solely of my said Wife as freely and effectually to all intents and purposes and in all respects as if they only and no other person had been by me originally constituted Executors thereof
And whereas I have in and by my said Will given to each of the Children of my brother in law JOSEPH LINDO a certain Legacy I do hereby confirm the same in every respect with this addition I give to each of the said Children the additional sum of twenty pounds
And whereas I have in and by my said Will given to Mrs.  LINDO the Wife of the said JOSEPH LINDO a Legacy of one hundred pounds I do hereby likewise confirm the same and in addition thereto do give to her the sum of one hundred and fifty pounds which said legacies with the additions herein mentioned I will shall be paid as follows to wit those to the Children to be paid to their father and mother for them and for their not until they respectfully arrive at full age or sooner if their parents think proper to give it to them the legacy to Mrs. LINDO with the addition herein mentioned to be paid to herself all which legacies and additions thereto to be paid by my Executrix and Executors without interest as soon as will suit their convenience I give and bequeath to JOSEPH EWBANK a brown boy in the Island of Jamaica the sum of fifty pounds to be paid to him by my Executrix and Executors when he arrives to the age of fifteen years and I do hereby ratify and confirm my said Will and all the gifts devises bequests treaties and things therein contained and not hereby altered and revoked
In Witness whereof I the said JOSEPH DA GILAR have hereunto set my hand and seal this thirteenth day of October in the year of our Lord one thousand eight hundred and seven

ON the 29th October 1824 Admon [Administration] with the Will and Codicil annexed of the Goods Chattels and Credits of JOSEPH D'AGUILAR formerly of the Island of Jamaica but late of Bergen in the State of New Jersey in the North America Esquire deceased was granted to ABRAHAM QUIXANO HENRIQUES the lawful Attorney of REBECCA LINDO Wife of ALEXANDER JOSEPH LINDO Esquire heretofore D'AGUILAR Sp: the natural and lawful daughter and only Child and as such the residuary legatee named in the Will being first sworn duly to Adm: [Administer] for the use and benefit of the sd: [said] REBECCA LINDO now residing in the Island of Jamaica REBECCA D'AGUILAR  in the Codicil written DAGILAR W: [wife] the Relict one of the Executors named in the said Codicil and the residuary legatee for life named in the said Will and DANIEL MOORE and DAVID BRAVO  Esquires the other Executors named in the said Codicil and the residuary Legatees in trust named in the said Will respectively survived the said deceased but are all since dead without having taken upon them or either of them the probate and Execution of the said Will & Codicil or the Letters of Admon [Administration] with the Will and Codicil annexed of the Goods of the said deceased.


Copy of the will of John Green

Jamaica. - In the name of God Amen
I John Green of the Parish of St Elizabeth in the county of Cornwall and island of Jamaica being of sound mind, memory and understanding, but mindful of the of the uncertainty of this transitory life, do make and publish this my last Will and Testament in manner and form following-
I give and bequeath to my dear and ever honoured mother Jane Green of Brantingham in the East Riding of the county of York and Kingdom of Great Britain, the sum of Fifty Pounds sterling per annum during her natural life to be paid to her free of all expense and to commence from the day of my decease.
All the rest residue and remainder of my estate, whether real or personal and wheresoever situated I give to my dear brother William Green of Brantingham in the East Riding of the county of York trusting that he will discharge all just demands against my estate and see the annuity applied as directed - but in the event of the death of my said dear brother William I then will and direct that all the remainder of my estate real and personal shall be divided amongst the children of my said dear brother William. Sons and Daughters lawfully begotten who may be then alive - share and share alike and I do hereby appoint him the said William Green, John Racker Webb, Luke Bramwell and Thomas Powell, the three last of the parish of St Elizabeth in the county of Cornwall and island of Jamaica Esquires, Executors of my last Will and Testament and I do hereby evoke and disannul all former Wills and Testaments whatsoever.  To the truth hereof I do I hereby set my hand and seal declaring this only written on two sides of one sheet of paper to be my last Will and Testament Ninth day of April, One thousand eight hundred..

Jamaican Family Search Notes:

1. This is a transcription of copy of a will that was found among Green family documents in East Riding, Yorkshire, England.  There was no indication on it that the will had been probated.

2. In the St. Elizabeth Parish Register, Volume I, p. 247 among the entries for the Burials of White People, there is John Green, Esquire, aged 32, buried at Archbold's in St. Elizabeth on May 20, 1813.
