WILL OF ALEXANDER DACOSTA

JAMAICA S.S.

        I, ALEXANDER DACOSTA, of the city and parish of Kingston, Tavern Keeper, hereby revoke all former Wills and Testamentary dispositions which may heretofore have been made by me and declare this to be my last Will and Testament. I appoint my wife Adelaide Elizabeth DaCosta, my natural son Stanley Alexander DaCosta, and my adopted daughter Myrtle Hermina Dixon (also called DaCosta) Executors of this my Will.  I give and bequeath unto my said wife, my furniture goods and chattels and personal property (excepting the piano which was a gift from me to my said adopted daughter Myrtle, and which gift I hereby confirm) and I also give and bequeath to my wife the goodwill of my Tavern and business carried on at No. 97 King Street Kingston known as "Hotel DaCosta" for her absolute benefit.  I give and devise my land and buildings thereon, at No. 97 King Street Kingston, aforesaid to my wife for and during the term of her natural life with remainder to the said Stanley Alexander DaCosta and Myrtle Hermina Dixon (or DaCosta) as joint tenants in fee simple.  I give and devise my land on the Red Hills Road and Constant Spring Road in the parish of Saint Andrew unto my wife her heirs and assigns forever.  All the rest residue and remainder of my estate, of whatsoever kind, and wheresoever situate, I give devise and bequeath unto the said Stanley Alexander DaCosta absolutely according to the nature and tenure thereof.  In Witness whereof I have hereunto set my hand this twenty third day of July One thousand Nine hundred and nineteen.

WILL OF DANIEL RODRIGUES DACOSTA

Dated 24 April 1875. Entered Sup. Ct. Book No. 1, Folio 211, 9 January 1882

Jamaica Ss-In the Name of God-Amen-This is the Last Will and Testament of me, Daniel Rodrigues DaCosta of the city and Parish of Kingston in the county of Surry in this Island, Merchant-I direct that all my just debts, Funeral and Testamentary Expenses be paid and satisfied as soon as possible after my death.  I give and bequeath the sum of One Hundred Pounds to my dear Mother Esther, the widow of Joseph Rodrigues DaCosta late of Kingston Gentleman. And as to all the rest residue and remainder of my Estate both real personal and mixed whatsoever and wheresoever situate whether in possession reversion remainder or expectancy I give, devise and bequeath the same unto and to the use of my dear wife Cordelia Margaret during her life without empeachment of waste and immediately after her death. I give, devise and bequeath the same absolutely unto and to use of all and every the children of our Marriage equally to be divided between and amongst them share and share alike.  I hereby appoint my said dear wife Executrix and my Brother Samuel Rodrigues DaCosta and John Delisser of Trelawny, Gentleman, Executors of this my will hereby revoking all wills at any time heretofore made by me and declaring this to be my Last Will and Testament.  In witness whereof I have hereunto set my hand this twenty fourth day of April in the year one thousand eight hundred and seventy five.

        This is the last Will and Testament of me Daniel Rodrigues DaCosta of the city and parish of Kingston in this Island Gentleman.  I direct payment of all my just debts funeral and testamentary expenses and I appoint my wife Emily DaCosta Executrix of this my last Will.  I give devise and bequeath unto my said wife Emily DaCosta all my estate both real and personal which I may die received or possessed of or entitled to in any manner or may have any disposing power over at the time of my decease.  And I hereby revoke all former Wills and testamentary dispositions which may have been made by me and declare this to be my last Will and Testament.  I Witness whereof I have hereunto set my hand this second day of December in the year of Our Lord one thousand nine hundred and one.

Will of JOSEPH RODRIGUES DACOSTA

Entered 3rd November 1910

This is the last will of me Joseph Rodrigues DaCosta of 57 East Queen Street, Tavern Keeper, hereby revoking all former wills.  I appoint my wife Hannah and my son David Rodrigues DaCosta the Executrix and Executor of this my will.  I give and bequeath the following legacies.  To my said son David Rodrigues DaCosta exclusive of his commissions as Executor the sum of three hundred pounds, to my son Eugene DaCosta the sum of three hundred pounds, to my daughter Mrs. Couch the wife of Frederick W. Couch the sum of three hundred pounds, to my brother Melbourne DaCosta one hundred pounds and to my sister Alice Levy one hundred pounds.  All the rest residue and remainder of my estate real or personal I give devise and bequeath to my said wife Hannah exclusive of commissions of Executrix.  As witness my hand this 19th day of July 1910.

WILL OF SOLOMON RODRIGUES DACOSTA

This is the last will and testament of me Solomon Rodrigues DaCosta of Tryall Pen in the parish of St. Mary.

I bequeath to my sisters Ethel Lillian Motta and Marie Louise DaCosta as tenants in common all my interest in Tryall Pen with household furniture and silver with mule wagon and harness and four mules:  Briton, Mary, Molly and Sarah for themselves forever.  The residue of my property real and personal wheresoever situate, after defraying my funeral expenses and debts, I bequeath to John Delisser One Hundred pounds and the remainder to Samuel Naylor Silvera and Chandos Herbert Silvera to be equally divided between them.  Lastly I appoint my uncle Victor Emanuel Silvera my executor of this my last will and testament.  As witness to my hand this third day of March One thousand nine hundred and eight.

WILL OF ALEXANDER FEURTADO

Filed in the Record Office the 8th December 1906

This is the last Will and Testament of me Alexander Feurtado of Kingston in the Island of Jamaica Lumber merchant.  I appoint the Administrator General of Jamaica for the time being to be the Executor and Trustee of this my Will with full power and authority to perform the trusts hereby _____ of him and so carry out the directions contained in this my Will.  I direct that my wharf premises consisting of the whole block between Port Royal Street to the North, the Harbour of Kingston to the South East, Street, to the East and Johns Law to the West, together with their appurtenances shall with all convenient speed be by my executor sold for no less than Ten Thousand Pounds either by public auction or by private contract, and that he shall stand possessed of the proceeds of such sale upon trust to invest the same in any of the securities or modes of investment herein specified and with full power of varying such investment and upon trust to pay and apply the interest and income thereof for the maintenance/education and advancement in life of my grandson Harry Osborne Carter and when and as soon as possible after the said Harry Osborne Carter shall attain the age of Twenty One years to pay over to him the said trust fund or transfer to him the investments representing the same as the case may be. And if the said wharf and lands shall not have been sold to convey and transfer the same to him subject to the grant of residence in favour of my son Zachariah Brice Feurtado hereinafter mentioned provided always that it is my Will and desire that until sale of the said wharf premises the said Zachariah Brice Feurtado shall be entitled to the use and occupation of the apartments situate upon the said wharf lands which he now occupies.  I direct that my wharf lands and hereditaments situate at the West end of Kingston aforesaid in Water Lane commonly called and known as "Waldron's Wharf" or "Feurtado's Wharf" shall be sold for not less than Four Thousand Pounds by my said Executor either by public auction or private contract and the proceeds of such sale shall be by him held in trust to invest the same in any of the securities or modes of investment herein specified and with the full power of varying any such investment and shall pay and apply the interest and income thereof for the maintenance education and advancement of my grandson Cleveland St. John Smyth and when and as soon as possible after the said Cleveland St. John Smyth shall attain the age of Twenty One years do pay over to him the said trust fund or transfer to him the investments representing the same as the case may be.  And if the said wharf and lands shall not have been sold to convey and transfer the same to him absolutely in fee simple.  I give and devise unto my daughter Gertrude Deschamps of Kingston Widow all my other store premises and lands No. 90 Harbour Street situate at the South East corner of Harbour Street and Mark Lane together with the premises to the South extending to Port Royal Street for and during the natural life of the said Gertrude Deschamps and from and immediately after her decease to and for the use of or in trust for my grand-daughter Julia Ethel Louisa Smyth her heirs and assigns forever.  I give and devise my other store premises in the Harbour Street and being No. 99 Harbour Street in Kingston extending to Water Lane and now occupied by Mefers S. V. Duran and Company unto my daughter Ella Jane Carter for and during the term of her natural life free from marital control and from and immediately after the decease of the said Ella Jane Carter do and for the use of or in trust for her daughter Gladys Carter her heirs and assigns forever.  But I direct that if the said S. V. Duran and Company shall give up the tenancy my son-in-law Harry Carter shall be at liberty to occupy the same as a store for himself free of rent whilst engaged in business therein on his own account.  I declare that my executor may postpone the conversion of any of my real estate hereby directed to be sold for as long a time as shall to him appear desirable.  I give and devise to my youngest daughter unmarried Ethel Marcella Feurtado my store and premises and lands situate in Harbour Street and being No. 134 Harbour Street extending to Port Royal Street, Kingston and now occupied by Mefers Isidore Solomon and Sons for and during the term of her natural life and from and immediately after her decease to and for the use of or in trust for my grand-daughter Brenda Smyth her heirs and assigns forever.  I devise to Matilda Louisa Langley the lands and premises No. 72 Mark Lane Kingston for her own use in fee simple.  I devise to the said Gertrude Deschamps No. 86 Fleet Street, Kingston for her own use in fee simple.  I devise to my said Trustee the lands and premises No. 3 Fleet Street, Kingston and also the penn in Saint Catherine known as The Ferry Penn to hold the same to the only proper use and behalf of my grand-daughter Julia Ethel Louisa Smyth and I direct that the proceeds and income from the said lands shall be applied for the benefit of the said Julia Ethel Louisa Smyth and upon her attaining the age of Twenty One years all the said lands shall be by my said Trustee transferred and conveyed to the said Julia Ethel Louisa Smyth in fee simple in like manner.  I give and devise to my Trustee the lands known as Prospect and Claremont in the parishes of Saint Andrews and Saint Catherine to be by him held in trust for my grandson Cleveland St. John Smyth and to be conveyed to him on his coming of age, but I declare that if they can be sold to advantage a sale is to be made by my Trustee and the proceeds invested for the benefit of the said Cleveland St. John Smyth in like manner.  I give and devise to my said Trustee the lands and store premises at the South East corner of Port Royal Street and Temple Lane Kingston occupied by Mefers N. S. Myers and Son to be by him held in trust for my grand-daughters Elsie Carter and Gladys Carter and to be conveyed to them or the survivor of them on coming of age in like manner.  I give and devise to my said Trustee my lands No. 42 Johns Lane in Kingston to be by him held in trust for my grand-daughter Gladys Carter and to be by him conveyed to her in like manner upon her coming of age.  I devise my house and premises No. 97 East Street, Kingston unto my daughters Ella Jane Carter, Gertrude Deschamps and Ethel Marcella Feurtado my son-in-law Harry Carter and my grand children Cleveland St. John Smyth, Brenda Smyth, Julia Ethel Louisa Smyth, Elsie Carter and Harry Debow Carter and to the survivors or survivor of them as joint tenants in fee simple, but I declare that it is my intention and desire that the said premises shall be occupied as a family residence and that as long as such parties shall dwell in harmony therein such premises not be sold.  And I hereby authorize and empower my Trustee at any time upon the request of the majority of such parties and upon its being represented to him that they cannot dwell harmoniously therein absolutely to make a sale of and dispose of the same premises and pay to apply for the benefit of such parties the net proceeds of any such sale and no purchaser from him shall be concerned as to the propriety or regularity of such sale or as to the application of the purchase money.  I declare that any moneys directed y this my Will to be invested may be so invested in the purchase of or upon the security of any Government securities of the United Kingdom or of the Island of Jamaica or any interest with the Colonial Bank or the Bank of Nova Scotia or upon the security of any freehold property in the Island of Jamaica and in any form of securities authorized by the Law of Jamaica appertaining to investments by Trustees and may from time to time at his discretion vary alter and transpose all or any of the Stocks funds and securities into or for other stocks funds or securities of the same or a like nature.  I give and devise unto my daughter the said Ethel Marcella Feurtado No. 57 East Street, Kingston and No. 40A Johns Lane for her own use in fee simple.  In consideration of the unfailing kindness and attention paid to me by my daughter Gertrude Deschamps I direct that the income from my deposit of Two Thousand Pounds with the Colonial Bank be paid to her as long as she shall live, the payments to be made half yearly and that after her death the capital sum shall fall into and become part of my residuary estate.  And I authorize my Trustee to continue the investment with the Colonial Bank or to withdraw it as and when he shall think desirable and re-invest the amount in any other form of investment authorized by this my Will.  I empower my Executor to pay and satisfy or compromise any debts owing or claimed to be owing by or from me or my estate and any liabilities to which I or my estate may be or be alleged to be subject, and to accept any composition or any security real or personal for any debts owing to me or my estate and to allow such time for the payment of any such debt or composition as to him shall seem reasonable and to refer to arbitration and settle all debts accounts claims questions and things which shall be owing or claimed to be owing from or to me or my estate or be depending or arise between me or my executor and any other person or persons and generally to act in relation to the premises in such manner as he shall think expedient without being liable for any loss occasioned thereby.  I direct, appoint and declare that my executor and Trustee the said Administrator General shall be and stand possessed of my residuary Real estate any the proceeds of any sale thereof and of my personal estate not specifically bequeathed and any part of my property which shall fall into the residue upon trust thereof after paying all my just debts and funeral and Testamentary expenses and the costs and charges of carrying into effect this my Will and the trusts thereof to convey and transfer pay and divide any surplus or remainder of my estate equally to and amongst my said four daughters Matilda Louisa Langley, Gertrude Deschamps, Ella Jane Carter and Ethel Marcella Feurtado or such of them as shall be alive at the time of my decease.  I bequeath the following pecuniary legacies which I direct shall be free of all legacy estate or other duty or charge.  To my Daughter Matilda Louisa Langley Five Hundred Pounds.  To my Daughter Gertrude Deschamps One thousand Five Hundred Pounds.  To my Daughter Ella Jane Carter One thousand Five Hundred Pounds.  To my Daughter Ethel Marcella Feurtado One thousand Five Hundred Pounds.  To each of my six grand-children One thousand Pounds.  To my Son-in-law Harry Carter One Thousand Pounds.  To my son Zachariah Brice Feurtado One thousand Pounds.  But upon the express condition that he the said Zachariah Brice Feurtado yield up to any Trustee all deeds documents seripo receipts and things in his possession belong to my estate and that he give full information to my Trustee as to the assets debts and matters of my estate within his knowledge.  And I direct that the said Zachariah Brice Feurtado shall be paid a salary of Two Pounds Ten Shillings per week for a period of Six months after my death and I also bequeath the following pecuniary legacies which I direct shall be free of all legacy estate or other duty or charge whatsoever.  To the Pastor for the time being of the Scotch Church Duke Street Kingston aforesaid the sum of Two Hundred Pounds to be by him applied for the purposes o that Church and I declare that the receipt of the Pastor shall be a sufficient discharge to my executor for such payment.  To my faithful servant Alfred Miller I give the sum of Thirty Pounds.  To my servant Edward Thomas Ten Pounds.  To Alexander Evans alias "____" Ten Pounds.  I direct that my unmatured shares in the Kingston Benefit Building Society shall be kept up until they mature and of my personal estate and that at maturity the amounts shall be drawn by my Trustee and become part of my residuary personal estate, all shares which have been or shall be taken by me in the Kingston Benefit Building Society in the name or names of any of my children and all moneys lodged by me in the Government Savings Bank in the names of myself or of myself and any of my Children I declare to be my property and part of my estate and I desire that any such moneys shall go on account of the pecuniary legacies given to them by this my Will.  And I direct any such child in whose name any such shares or moneys may stand or in whom they may on my death technically devolve to hold the same in trust for my Trustee and to sign all documents and to do all acts necessary and proper to effectually vest the same in my Trustee upon the trusts hereby imposed upon him.  I direct that my Solicitor Mr. Charles McDonald Ogilvie be employed in and about the proving of this my Will and the affairs of my estate and generally as the professional advisor in respect thereof.  And I hereby revoke all other Wills or Codicils by me at any time made and declare this to be my only one and last Will and Testament.  In witness whereof I have hereunto set my hand this Fourteenth day of December One thousand Nine hundred and Four.

WILL OF ALEXANDER FEURTADO, JR.

Filed in the Record Office this 16th day of July 1903

Jamaica S.S. The Last Will and Testament of Alexander Feurtado (Junior) of No. 21 Hanna Street Rae Fouer in the City and Parish of Kingston in the Island of Jamaica, being in bad health of body but not of mind and memory.  Thanks be given to God and knowing that it is appointed for all men once to die and after death the judgment do make and ordain this to be my last Will and Testament.  That is to say principally and first of all, I give and recommend my soul unto the Land of God that give it and my body I do recommend to the earth to be buried in a decent Christian burial at the direction of my Executrix my wife Henrietta Feurtado nothing doubling but at the general resurrection I shall receive the same again where with it has pleased God.

I give devise and dispose of the same in the following manner and form.  I give and bequeath to my wife Henrietta Feurtado that house and premises (less one room for Emily Labechie) for the term of her natural life known as No. 21 Hannah Street.

I also give and bequeath to my wife Henrietta Feurtado and Emily Labechie all that piece and parcel of land and premises known as Rollington Pen in the parish of Saint Andrew and named "Emily Villa" after sale, share and share alike and I mean after clearing up all my real and personal effects and debts.  I do hope that my wife Henrietta Feurtado and Emily Labechie will have in peace with each other as at this moment of the signing of my last Will and Testament.

In Witness Whereof I the herein before named Alexander Feurtado have here unto set my hand and seal this 18th day of July in the year of our Lord Nineteen hundred and one, signed, sealed and declared by me the said Alexander Feurtado as my last Will and Testament.  In his presence and in the presence of each other who have hereunto subscribed our names.

        This is the last and only Will and Testament of me Ella Ernestine Feurtado, the wife of Zachariah Brice Feurtado, of the parish of Saint Andrew.  I direct that all my just debts be paid out of my estate.  I will devise and bequeath unto my husband Zachariah Brice Feurtado the sum of Forty pounds sterling to be paid to him out of whatever money I may die possessed of.  I also direct that Henrietta Cook of the parish of Kingston shall have unto her sole use a room on my premises situate at No. 38 Foster Lane in the parish of Kingston for the natural term of her life.  I will devise and bequeath unto and to the use of my son Aubrey Alicio Skinner of the parish of Kingston all the residue of the estate and effects both real and personal I may die possessed of and of whatsoever nature and wheresoever the same may be situate absolutely.  I nominate constitute and appoint the Administrator General of this Island to be Trustee and Executor of this my last and only Will and Testament during the minority of my son the said Aubrey Alicio Skinner and upon the said Aubrey Alicio Skinner attaining the age of Twenty one years I nominate constitute and appoint him the sole executor of this my last and only Will and Testament.  Dated 10th day of June 1909.

THIS IS THE LAST WILL AND TESTAMENT of me MARY ANN PRESTWIDGE of the City and parish of Kingston Spinster.  I HEREBY REVOKE all Wills and Testamentary dispositions heretofore by me made.  I DIRECT payment out of my general estate of all my funeral and Testamentary expenses.  I APPOINT Philip Polson Dunbar of the parish of St. Mary to be the Executor of this my Will.  I DIRECT that in the event of the terms of the Leases now existing in respect of my premises at Annotto Bay in the parish of Saint Mary to Seward Scott Smith and Philip Polson Dunbar respectively expiring before my death both the said premises shall respectively be forthwith sold in one lot and the net proceeds after payment of all expenses divided and paid as follows:  As to one half to Lilian Charlotte Prestwidge Feurtado and as to the other half I direct Fifty pounds thereout to be paid to Henrietta Euphemia Prestwidge in recognition of her kind attentions to me and the balance to be divided equally between my sister Elizabeth Oxley Feurtado and my brother Arthur Collette Prestwidge but should the term of one only of the Leases have expired at my death THEN I DIRECT that the premises appertaining to such lease shall forthwith be sold and the net proceeds of such sale lodged in the Government Savings Bank pending and until the sale of the premises appertaining to the subsisting lease as hereinafter directed and in the meantime and until such sale I GIE AND BEQUEATH the said profits and income thereof to the person or persons hereinafter entitled to receive the income of all moneys lodged in the Government Savings Bank in pursuance of this my Will.  Should neither of the terms of the leases aforesaid have expired then I DIRECT that the rents in respect of the premises leaded to Seward Scott Smith as aforesaid subject to the terms of his Lease shall belong and be payable to the said Elizabeth Oxley Feurtado and Arthur Collette Prestwidge in equal shares until the expiration of the term thereof AND the rents in respect of the premises leaded to Philip Polson Dunbar as aforesaid SUBJECT to the terms of his Lease shall belong and be payable to the said Lilian Charlotte Prestwidge Feurtado absolutely until the expiration of the term thereof I THEN DIRECT that the premises appertaining to the subsisting Lease AND I DECLARE that the income of  and interest upon all moneys lodged in the Government Savings Bank in pursuance of this my Will shall belong and be payable pending and until the expiration of the subsisting term to the party or parties who would but for such sale have been entitled to receive or had before been receiving the rents in respect of the premises sold AND upon the expiration of the last subsisting term I DIRECT that the premises appertaining thereto shall forthwith be sold AND the net proceeds of such sale together with all the moneys lodged in the Government Savings Bank (if any) in pursuance of this my Will shall go and be divided and payable in the same proportions and in the same way as hereinbefore firstly directed if the term of the Leases aforesaid mentioned should have expired at my death and subject to the payment of Fifty pounds to Henrietta Euphemia Prestwidge.  ALL the rest residue and remainder of my property real personal or mixed I GIVE DEVISE AND BEQUEATH unto the said Lilian Charlotte Prestwidge Feurtado for herself absolutely. IN WITNESS WHEREOF I have hereunto set my hand this eleventh day of July One thousand nine hundred and seven.
