WILL: ...being very sick and weak in body but of sound memory and understanding do make ordain publish and declare this my last Will and Testament. ...I give and bequeath unto my reputed son Thomas Burke [next page not copied by IRO]...as soon after my executors can get my affairs settled as any opportunity offers in purchasing two Negro boys for the proper use and benefit of my said reputed son Thomas Burke which two Negro boys I desire to be sent to a trade and after serving their apprenticeship to be hired out and their wages to be entirely applied to and for the education subsistence and maintenance of my said reputed son Thomas Burke until he shall attain the age of twenty-one years and then to be put in quiet and peaceable possession of the above 2 Negroes as his real and absolute property by my executors or the heirs executors administrators or assigns of them or any one of them and not be liable to any debts or impeachments whatever on his the said Thomas Burke's Account...to inherit for his entire use and benefit during his life and afterward the said two Negro slaves to return to my next heirs in Ireland should he the said Thomas Burke my reputed son die without issue.

Item. I give and bequeath to Margaret Prendergast the mother of my said reputed son Thomas Burke in consideration of her faithful servitude and good behaviour the sum of £54 current money of Jamaica to be laid out in the purchase of a Negro wench for the use and benefit of her the said Margaret Prendergast during her life together with the issue offspring and increase of the said Negro wench slave together with her future offspring issue and increase to have and to hold during her natural life and after her death the said Negro wench with her offspring and increase to come to my heirs in Ireland.

Item. It is my will and desire that the rest residue and remainder of my property should be remitted as soon as possible to my father Mr. Myles Burke of Timard in the County of Galway and Kingdom of Ireland to be by him equally divided amongst my family, viz. my father mother brothers and sisters share alike. My silver shoe buckles pistols and stock buckles not included as I give and bequeath the said silver shoe buckles pistols and stock buckles unto my kinsman Mr. Rickard Burke as a token of my particular esteem and regard for him.

Item. It is my will and device that in case of my father's death before the receipt of the rest residue and remainder of my property by him that my brother Mr. John Burke of Timard in the County of Galway and Kingdom aforesaid may and is fully authorized by me to receive and distribute the same in manner and form aforesaid to wit that is to say amongst my family father mother brothers and sisters or such of them as may be still living share and share alike.

And lastly I constitute nominate and appoint my kinsmen Messrs Rickard Burke of Maverly Estate in the parish of St. Andrew County of Surry and William Burke of Cornwall in the parish of Portland both in the island aforesaid planters to be my executors and guardians to my reputed son Thomas Burke . . .
