My executors Richard Brissett and Simon Taylor are to hold in trust for payment of my bequests all "my plantations lands tenements and hereditaments in the parish of Hanover...and all other real estate wheresoever situate and the Negroes stock utensils heredits and appurts thereunto belonging...", for the use of my son Neill Malcolm and his heirs during his natural life, and in default of him, for my brother Donald, and then my brother George, and descendants, excluding my sister Margaret and my brother Colin, but not their heirs. April 17, 1802, witness Charles Birbeck Andree swore to the signatures on the will.

June 2, 1802, Administration with the Will annexed was granted to Neill Malcolm, the son of the deceased and residuary legatee. Dugald Malcolm, Richard Brissett, Richard Atkinson, and John Allen all died during the lifetime of the testator. Edward Robinson renounced the executorship. Simon Taylor and the brothers of the testator, Donald Malcolm and George Malcolm, the other executors, were cited to appear or refuse the probate, but they did not appear.

He was a slave-owner. One of his slaves, Sally Malcolm, was baptized in 1805.

SUMMARY of WILL:

[The will is 9 pages long]

1. I confirm a settlement which gave my wife Robona Elizabeth £1,150 annually for life.

2. I bequeath to my wife Robona all my household furniture, books and rare books in my library.

3. To my son Neill Malcolm by my said wife Robona Elizabeth Ladoux the sum of £20,000, to be paid to him when he reaches the age of 25 years.

4. If Neill dies without a lawful heir before he is 25, the £20,000 is to be divided into eighths and distributed as follows:

2/8 the annual produce to go to my wife Robona during her life

2/8 to my dear nephew Neill Malcolm of Hanover Square, county of Middlesex, Esquire.

2/8 to my nephew John Malcolm of Jamaica, barrister at law, son of my brother George Malcolm

1/8 to the living children of my sister Mrs. Margaret Campbell of Ardlamont in Scotland

1/8 to children of my nephew John Campbell of Ashfield in Scotland

5. If Neill dies before 25, leaving a widow, she is to receive £200.

6. I give to my dear goddaughter Mary Malcolm, daughter of my said nephew Neill Malcolm £2,500. If she is deceased [provisions] the money is to be invested, and the dividends given to my wife Robona provided she is alive and remained a widow.

7. To each of my executors 20 guineas to buy a ring, or any other token of remembrance of me.

8. To my sister Marie Malcolm an annuity of £98.

9. To my reputed daughter Mary Malcolm by Sarah Ruiz an annuity of £49.

10. To my sister Margaret Campbell of Ardlamont aforesaid an annuity of £25.

11. To my reputed daughter Marie McIsaac the wife of Dugald McIsaac an annuity of £35.

12. To my reputed daughter Mary McCallum the wife of Donald McCallum an annuity of £35.

13. My executors are to manumit and set free my Negro slave Mary Malcolm and her future issue and offspring, and I do hereby as far as I legally can, make an account of her uniform good conduct more particularly exemplified whilst in Great Britain with me and my wife, and she is to be paid the yearly sum of £10.

14. To my executors in trust the plantation or sugar work called Alexandria situated in Hanover, and pens Montpelier in Hanover, White Hill and Barrant's in St. Elizabeth with "slaves cattle stock and appurts upon and belonging to the said plantation and pens respectively, and all other my real estate slaves ... in Jamaica". All sugar is to be shipped and consigned to Messrs. Stirling Gordon and Company in Glasgow, or to such other persons as the executors design. From the proceeds the executors are to pay my bequests.

15. The executors are to provide an annual sum of £70 for the maintenance and education of Henry William Downs until the sum of £500 also bequeathed to him is payable at age 21. He is a son of my wife, late at Mr. Thomas Wrights Academy of South Town near Yarmouth, now on board His Majesty's Ship Bonsoir
