Precis:-

This deed transfers 35 acres of land in Hanover from John & Elizabeth Clarke to their son William Virgo Clarke [1]. The land changes hands for £350. A fairly detailed description of the land is given and it mentions that it is part of a larger run owned by John Clarke. A sketch map, drawn to scale is also included. According to my 1 inch to the mile Ordnance map of Hanover there are two possible locations.

        This Indenture made the twenty second day of February in the thirty third year of the Reign of our Sovereign Lord George the third by the grace of God of Great Britain France and Ireland King and of Jamaica Lord defender of the faith and so forth and in the year of our Lord One thousand seven hundred and ninety three. Between John Clarke of the parish of Hanover in the county of Cornwall and Island aforesaid Esquire and Elizabeth his Wife of the One part and William Virgo Clarke of the Same parish County and Island of the other part Witnesseth that for and in Consideration of the Sum of Three hundred and fifty pounds current money of Jamaica to him in hand Well and duly paid by the said William Virgo Clarke at or Immediately before the sealing and delivery of these presents the Receipt Whereof the said John Clarke doth hereby Acknowledge and thereof and therefrom and of and from every part and parcel thereof doth hereby release Exonerate and discharges the said William Virgo Clarke his heirs Executors Administrators and Assigns [....?] of them by these presents .[..?] the said John Clarke and Elizabeth his Wife hath granted bargained sold, assigned enfeoffed conveyed and Confirmed and heretofore presents Doth grant bargain sell enfeoff Convey and Confirm unto the said William Virgo Clarke his heirs and Assigns for ever All that piece or parcel of land lying and being in the parish of Hanover in the County and Island aforesaid containing by Estimation thirty five Acres butting and bounding northerly on land patented by Oliver Badaroux and now in the possession of William Brown Junior  Southerly on a spring Easterly on Aurora and Crook's penn south Easterly on parts of the same land belonging to the said John Clarke Southerly and South Westerly on the Kings Road and Westerly on Riley's Penn As by the plan which is hereunto annexed more fully and Clearly will Appear being part and parcel of a larger run of Land patented by Richard Haughton together with all and every the Houses Courthouses Edifices Erections and Buildings thereon Erected and Built and all paths passages Waters Water Courses Woods Wood  [...?] Timbers Timber Trees feedings feeding places Commons and Commons of pasture fishings fishing places priviledges profits Commodities Advantages Hereditments and Appurtenances Whatsoever to the said piece or parcel of land belonging or in any Wise Appertaining or herewith or theretofore or any part or parcel thereof usually had held and occupied possessed reported deemed taken or known as part parcel or member thereof And the Reversion and Reversions Remainder and Remainders Rents Issues profits and produce of the said piece or parcel of Land and premises and of every part and parcel thereof And also all the Estates Right Title Interest property Inheritance Claim and demand whatsoever both at law and in Equity of him the said John Clarke and Elizabeth his Wife their heirs Executors Administrators and Assigns of in to or one of the same and every or any part and parcel Thereof and all deeds Evidence Letters Patent Muniments and other writings Whatsoever touching or concerning the same or any piece or parcel thereof To have and to hold the said piece or parcel of Land and all and singulary the Premises hereinbefore granted and conveyed or meant mentioned or intended so to be unto the said William Virgo Clarke his heirs and assigns to the only proper use benefit and Behoof of the said William Virgo Clarke his heirs and Assigns for ever and to and for no other use Interest or purpose Whatsoever And the said John Clarke and Elizabeth his Wife for themselves their heirs Executors Administrators and Assigns doth hereby covenant promise and agree to and With the said William Virgo Clarke his heirs and assigns in manner and form following (that is to say) that he the said John Clarke and Elizabeth his Wife hath in themselves at the time of the sealing and delivery of these presents good Right full proven and lawful Authority to grant bargain sell and convey the said piece or parcel of Land and premises mentioned or intended to be hereby granted bargained sold and conveyed With the Appurtenances unto or to the use of the said William Virgo Clarke his heirs and assigns in manner aforesaid and according to the purposes true Interest and meaning of these presents And also that it shall and may be Lawful to and for the said William Virgo Clarke his heirs Executors Administrators and Assigns from time to time and at all times hereafter peaceably and quietly to enter into and upon and to take possession of and have hold Occupy now possess and enjoy all and singular the said piece or parcel of Land and premises herein before granted and conveyed or meant mentioned or intended so to be With the Appurtenances and shall and may take receive retain Keep and Apply to his and their [...?] uses and behoof and [....?] the Rents Issues & profits and produce thereof Without any let Suit Trouble demand Molestation hindrance or Interuption of from or by the said John Clarke and Elizabeth his Wife their heirs Executors or Administrators or of or from any other person or persons Whatsoever And that Free and Clear and freely and Clearly Acquitted Exonerated and discharged or otherwise Well and sufficiently saved Kept harmless and Indemnified of from and against all and all manners of former Gifts Grants bargains Sales Leases Mortgages Wills Intails Titles Jointures dowres and thirds and Right and title of dowres and thirds Judgments Executions Extents Rents and Arrear[..?] of Rent and of from and against all other Titles Troubles Charges and Incumbrances Whatsoever at any time or times hereinafter had made committed permitted or suffered to the Contrary And further that he the said John Clarke and Elizabeth his Wife their heirs Executors and Administrators and all and every other person or persons Whatsoever Claiming or to Claim by from or under or in Trust for them any Estate Right Title Interest use Trust possession property profit Inheritance Claim or demand Whatsoever either at Law or in Equity of in to or out of the said piece or parcel of Land and premises hereinbefore granted and Conveyed meant mentioned or Intended so to be or any part thereof shall and Will from time to time and at all times hereafter upon the reasonable request and at the proper Costs and Charges in the law of the said William Virgo Clarke his heirs Executors Administrators  or Acknowledged and Suffered all and Every such further and lawful and reasonable Acts deeds Conveyances and Assurances in the [...?] Whatsover for the further better more perfect and absolute granting conveying and Assuring the said piece or parcel of Land & premises hereinbefore granted and Conveyed or meant mentioned or intended so to be with the Appurtenances unto the said William Virgo Clarke his heirs and Assigns to the only proper use and behoof of the said William Virgo Clarke his heirs and Assigns in manner aforesaid according to the true intent and meaning of these presents as by the said William Clarke his heirs and Assigns or his or their Council Learned in the Law shall be reasonably advised devised or required And lastly that he the said John Clarke and Elizabeth his Wife their heirs Executors or Administrators all and singular the said piece or parcel of Land and premises hereinbefore granted and conveyed or meant mentioned or intended so to be With the Appurtenances unto the said William Virgo Clarke his heirs and Assigns and against himself the said John Clarke and Elizabeth his Wife their heirs Executors and Administrators and against all and every other person or persons whatsoever shall and Will Warrant and for ever defend by their presents In Witness  Whereof the said John Clarke and Elizabeth his Wife hath hereunto set their hands and fixed their seals the day and year first above written

        The above diagram represents Thirty five acres of land in the parish of Hanover the property of John Clarke Esq which is to be Conveyed by him to his son Mr William Virgo Clarke and is bounded Northerly on Land patented by Oliver Badaroux now in the possession of Mr William Brown Southerly on a spring Easterly on Aurora & Crooks penn South Easterly on part of the same run belonging to John Clarke Esq Southerly and South Westerly on the Kings Road and Westerley on Rileys penn as by the platt above more fully Appears Surveyed & Delineated by a scale of 20 Chains to an Inch the 6th February 1793.

Precis:-

This deed sells 300 acres of land near Lucea to John Clarke for £2500 on 10 Aug. 1769. It probably belonged to Isaac Cresse & his wife but was mortgaged to Peter Beckford [the largest of all the Jamaica Planters] since the £2500 is paid to him [via his attorney since Beckford is resident in Dorset, England] and only ten shillings is paid to Cresse. Thanks to the attached plan it is possible with considerable certainty to find it's position on a modern Ordnance Map at Ref: 157550.

 This Indenture Tripartite made the Tenth day of August in the year of the reign of our Sovereign Lord George the third By the Grace of God of Great Britain and Ireland King and of Jamaica Lord defender of the Faith etc and in the year of our Lord One Thousand Seven hundred and sixty nine Between Isaac Cresse  of the Parish of Hanover in the County of Cornwall in the Island of Jamaica Esquire and Rebecca his wife of the first Peter Beckford of the County of Dorset in the Kingdom of Great Britain Esquire by Robert Mason of the said Island of Jamaica Esquire the true and lawful Attorney of the said Peter Beckford duly constituted and appointed and the said Robert Mason as Attorney of the said Peter Beckford of the Second Part and John Clarke of the said Parish of Hanover in the County and Island  aforesaid Planter of the Third Part Witnesseth that as well for and in consideration of the sum of two thousand five hundred pounds current money of Jamaica to the said Peter Beckford by his said Attorney in hand well and truly paid by the said John Clarke at or immediately before the Sealing and Delivery of  these Presents as also for and in Consideration of the Sum of ten shillings like current money to the said Isaac Cresse in hand well and truly paid by the said John Clarke at or immediately before the Sealing and Delivery of these Presents the receipt of which said several sums of Two thousand five hundred pounds and ten shillings the said Peter Beckford and Isaac Cresse do hereby respectively Acknowledge and thereof and therefrom and of and from every Part and Parcel thereof Do Acquit Releave and Discharge the said John Clarke his heirs Executors Administrators and Assigns and every of them for ever by these presents They the said Isaac Cresse and Rebecca his wife and with the Consent and Approbation of the said Peter Beckford by his said Attorney and also of the said Robert Mason as attorney to the said Peter Beckford testifies by their being parties to and Sealing delivering these presents Have and each of them hath Granted Bargained Sold Released Conveyed and Confirmed and by these Presents Do and each of them Doth absolutely Grant Bargain Sell Release Convey and Confirm the said John Clarke his heirs and Assigns all that piece or parcel of Land Situate lying and being in the Parish of Hanover in the County of Cornwall aforesaid Containing by Estimation three Hundred Acres being part of a Run formerly Patented by Sir Henry Morgan for four thousand acres Butting and Bounding Easterly on Land laid off  for Richard Welch Esquire South Easterly on land Patented by Edward Chambers and Michael Lynch South westerly on Mr John Wills and Isaac Cresse Esquire and North westerly on Isaac Cresse and James Kerr Esquires as will appear more fully By the Platt hereunto annexed which said three hundred acres of Land are part and Parcel of the Premisses Comprised in a certain Indenture of Mortgage bearing date on or about the first day of January last in and by the said Isaac Cresse and Rebecca his Wife and the said Peter Beckford and are also Part and Parcel of such part of the said mortgaged premisses as by the said Indenture of Mortgage the said Isaac Cresse his heirs and Assigns by and with the consent and Approbation of the said Peter Beckford his heirs Executors Administrators or assigns or some or one of his or their Attornies in this Island and in Writing under his or their hand Seals are Authorised and Impowered to sell and convey in any manner therein mentioned and all Ways Paths Passages Woods underwood Commons and Commoner Pasture Feedings Fishings Fishing Places Easements Privileges Profits Commodities Emoluments Advantages Hereditments and Appurtenances whatsoever to the said piece or parcel of land belonging or in any wise appertaining or therewith on to or with any Part or parcel thereof usually held Occupied Possessed or enjoyed or Accepted Reputed Deemed taken or Known as part parcel or         The above represents Three Hundred Acres of Land lying about two miles Southeast of Lucea Harbour in the Parish of Hanover in the Island aforesaid being part of run formerly Patented by Henry Morgan for four thousand acres and is now Conveyed unto John Clarke by Isaac Cresse Esq by the Deed hereunto annexed butting and Bounding North Easterly on Land laid off for Richard Welch Esquire South Easterly on Land patented by Edward Chambers & Michael Lynch South westerly on Mr John Wells & Isaac Cresse Esq & North westerly on Isaac Cresse & James Kerr Esqrs as will appear more fully by the Platt Surveyed & laid off this 4th day of August 1769
