COURTS OF LAW AND EQUITY

The Judicial Establishment of Jamaica consists of the Court of Chancery, Court of Ordinary, Court of Vice Admiralty, Vice Admiralty Sessions, the Supreme Court of Judicature, the Circuit Courts, District Courts and Courts of Petty Sessions.

COURT OF CHANCERY.

His Excellency the Governor is Chancellor, but he never sits nor interferes in any way with the Courts. It is held generally twelve times a year and is presided over by the Chief Justice, who is Vice-Chancellor. The jurisdiction and practice of this Court are nearly the same as the  Court of Chancery in England. Appeals from its decisions are allowed direct to her Majesty in Council.

COURT OF ORDINARY

     This Court meets when summoned by notice in the Jamaica Gazette.  His Excellency the Governor always presides, and the Chief Justice, as Surrogate, generally sits with him.  In this Court all Wills are proved and Letters Testamentary granted, as well as Letters of Administration on the personal Estate of persons dying intestate.  By a recent enactment, authority is given to direct disputed questions of fact to be tried by a jury.  By 18 Vic. cap. 34 and 6 Vic. cap 55, the Governor, as Ordinary, is authorized to direct payment of costs, to issue attachments, and also to issue commissions for proving Wills in places out of the island.
     Law No. 22 of 1874 confers a concurrent jurisdiction in matters not exceeding £200 on the District Courts.  Amended by Law 22 of 1870.

COURT OF ADMIRALTY SESSIONS

     Meets when summoned for the hearing and determination of criminal offenses committed on the high seas.  The Common Law Courts of the Island have now concurrent jurisdiction to dispose of such offenses.

Under Law 21 of 1868, the power to take Affidavits in the Supreme Court, which had been confined to the above Commissioners was extended to Justices of the Peace within their respective jurisdictions.

DISTRICT COURTS

     These courts, created by Law 35 of 1867, are intended to improve the administration of law in his Island; to render justice easily, quickly, and cheaply obtainable by all classes; and for the disposal, without delay, of all criminal cases of a common nature.
         The following are the names of the officers, and at the places and days of holding courts: --

THE KINGSTON DISTRICT COURT

     It having been found expedient to alter the districts in which the District Courts of Kingston, Spanish town and Port Antonio are now held, it is ordered by the governor, under the powers given by the District Courts Law, 1874, that from and after the first day of January 1877, inclusive, the Districts of the Courts aforesaid shall be as follows: and that courts shall be held at the places and at the periods as hereinafter set forth.
   The District of the Kingston District Court consists of the parishes of Kingston and St. Andrew, of so much of the Parish of St. Mary as formerly constituted the Parish of Metcalfe, and of so much of the Parish of Portland as formerly constituted the Parish of St. George.

     The Falmouth District includes the parishes of Trelawny, Saint Ann, and Retreat District in St. Mary. Courts are held in Falmouth, Brown's Town and St. Ann's Bay, once in every month.

E. H. Bravo and A. M. Jackson, of the Kingston District Court, to be Assistant Clerks of the Port Antonio District Court.
S. H. Cooke, of the Spanish Town District Court, to Be Assistant Clerk of the Kingston District Court
J. R. Facey of the Port Antonio District Court, to be Assistant Clerk of the Kingston District Court
A. R. White, of the Port Antonio District Court, to be also Assistant Clerk of the Kingston District Court
J. J. Drew, of the Spanish town District Court, to be Additional Bailiff of the Kingston
H. Absalom, of the Port Antonio District Court, to be Additional Bailiff of the Spanish Town
